Candidates and temporary workers
What we collect
- Identity and contact details: name, address, phone number, email address, date of birth, National Insurance number and emergency contact details.
- Right to work: copies of passports, visas, biometric residence permits, share codes or other documents we are legally required to check.
- Work history and suitability: CV, employment history, qualifications, training records, skills, job preferences, availability, interview notes, competency assessment results and references.
- Driving information (for driving roles): driving licence details and images, licence categories, endorsements and penalty points, CPC and tachograph card details.
- Payment details: bank account details, tax and pension information, timesheets, hours worked, expenses and holiday records.
- Documents you upload through our candidate portal, such as proof of address, certificates, timesheet photos and your signature on declarations.
- Health information: health and fitness-for-work declarations, and details of any accident or incident at work, including photographs.
- Criminal record information: unspent convictions you declare and, for roles that need one (for example in care), the outcome of a DBS check.
- Messages and calls: emails, text messages and portal messages between you and us. Calls may be recorded for training and quality purposes.
Where it comes from
Mostly from you: when you apply for a job, register your interest, fill in our forms or use the candidate portal. We also receive information from your referees, from job boards where you have made your CV available or applied for one of our roles, from the DBS and the Home Office online right-to-work service, from the DVLA licence-check service with your permission, and from the clients you work for (for example timesheet approvals and feedback).
How we use it, and our lawful basis
- To find you work and manage your placements: matching you to roles, introducing you to clients, booking shifts and keeping in touch. Lawful basis: to take steps at your request before entering a contract and to perform our contract with you.
- To pay you: processing timesheets, pay, tax, National Insurance, pension auto-enrolment and holiday pay. Lawful basis: contract and legal obligation.
- To meet our legal duties as an employment business: right-to-work checks, the Conduct of Employment Agencies and Employment Businesses Regulations 2003, the Agency Workers Regulations 2010, working time rules and health and safety law, including recording accidents. Lawful basis: legal obligation.
- To check you are suitable for a role: references, assessments, driving licence checks and, where the role requires it, DBS checks. Lawful basis: legitimate interests (making safe, suitable placements) and, where the law requires a check, legal obligation.
- To tell you about jobs by text, email or phone. Lawful basis: legitimate interests, as part of the work-finding service you asked us to provide. You can ask us to stop at any time.
- To run and protect our business: record keeping, audits, insurance, handling claims and complaints, and preventing fraud. Lawful basis: legitimate interests and legal obligation.
Health and criminal record information is given extra protection. We use it only where it is necessary for our obligations in employment, social security and social protection law (for example health and safety and accident reporting), for safeguarding where a role involves vulnerable people, or for legal claims, under Article 9(2)(b) and (f) UK GDPR and Schedule 1 of the Data Protection Act 2018. Only staff who need it can see it.
If you do not give us information we need, such as proof of your right to work, we may not be able to find you work.
Clients and business contacts
We hold the names, job titles and work contact details of people at our clients and at businesses we would like to work with. We also hold the details you give us when you request staff, approve timesheets or sign our terms, and records of our calls and emails with you (calls may be recorded for training and quality purposes). We use this to supply staff, manage accounts, invoice, manage credit, and keep in touch about our services. Our lawful basis is contract (where you or your organisation is a client) or legitimate interests.
If we contacted you about our services
We sometimes email businesses that are publicly advertising vacancies, to offer temporary or temp-to-perm staff. To do this we use the job advert itself (found through job boards and job search services), the business contact details the organisation publishes on its own website, and public Companies House records. We use software, including AI-assisted web research, to find and check this information; a member of our team reviews every email before it is sent. We only email limited companies and similar organisations at their business addresses, never personal email addresses.
Our lawful basis is legitimate interests: telling businesses that are recruiting about a relevant service. We keep this to a single, relevant email, and we do not contact the same organisation again within six months. Every email includes an unsubscribe link, and you can also reply “unsubscribe”. If you opt out, we keep a note of your email address and organisation so that we never contact you again.
Referees
When a candidate names you as a referee, they give us your name and contact details. We use them to request and record a reference about the candidate, and we may send you a few reminders if we have not heard back. Our lawful basis is legitimate interests.
Website visitors and cookies
When you use a form on this website (for example Register Your Interest, Request Staff, Contact or a job application), we receive the details you enter. We use them to respond to you, and keep them as described in this notice.
This website uses:
- Essential cookies that keep you signed in to the candidate or staff portal and keep the site secure. The site cannot work without them.
- Google Analytics cookies, which tell us how many people visit, which pages they use and how they found us. This information is aggregated, and we do not use it to identify you.
You can block or delete cookies in your browser settings. Blocking Google Analytics will not affect how the site works.
Who we share information with
- Clients you are put forward to or work for: your CV, relevant checks and qualifications, timesheets, and any information needed for your safety at work. We tell you before we send your details to a new client.
- Government bodies where the law requires it: HM Revenue & Customs, the Home Office, the DBS, the DVLA, the Health and Safety Executive, and the police or other authorities if legally required.
- Pension providers and insurers, and our professional advisers such as accountants and solicitors.
- Service providers who process data for us under contract, including our website and database hosting, Microsoft 365 (email), our payroll and timesheet software, our accounting software, Google (website analytics) and Anthropic (AI tools used for research and admin tasks). They may only use the information to provide their service to us.
We never sell personal information.
Transfers outside the UK
Some of our service providers, such as Microsoft, Google and Anthropic, may process information outside the UK, including in the United States. Where this happens it is protected by UK adequacy regulations (including the UK Extension to the EU-US Data Privacy Framework) or by the International Data Transfer Agreement or Addendum approved by the Information Commissioner.
How long we keep it
- Candidates we have not placed: two years from our last contact with you, then deleted.
- Workers we have placed: placement, timesheet and pay records for six years after the end of the tax year in which you last worked for us, as HMRC requires. Right-to-work copies for two years after your last assignment ends.
- Accident and incident records: at least three years, or longer if a claim is made.
- Records under the Conduct Regulations: at least one year from creation, or from the last time we supplied or introduced you, whichever is later.
- Business contacts: two years from our last contact, unless you are a current client. If you opt out, we keep a minimal “do not contact” record indefinitely so that we can respect your choice.
- Referee details: as long as we keep the candidate’s record.
How we keep it safe
Documents uploaded to our portal are stored privately. Only the candidate who uploaded them and authorised staff can open them. Staff accounts are password-protected, and access is limited to people who need it for their role.

You have the right to:
- ask for a copy of the personal information we hold about you;
- ask us to correct anything that is wrong or incomplete;
- ask us to delete your information (unless we must keep it by law);

To use any of these rights, email hello@resolverecruitment.co.uk. We will reply within one month. There is normally no charge.
